The Supreme Court, led by Justice Inyang Okoro, upheld the Appeal Court’s decision stating that a presidential candidate doesn’t need to secure a minimum of 25% of the votes in the Federal Capital Territory (FCT) to be declared the country’s president.

This decision followed an appeal by Atiku Abubakar and Peter Obi against Tinubu’s victory in February 2023.

The Appeal Court had previously ruled their petition as immaterial, a decision affirmed by the Supreme Court, emphasizing that the FCT holds no special status in this regard.
